Tata Fintech Private Limited (“Tata Fintech” or “we” or “our” or “us”) owns and proposes to operate a trading and stock broking platform, which will be made available at the website www.tatafintech.com and our mobile application (collectively referred to as the “Platform”) through which users, as per their suitability, can avail services offered and/or made available by us.

Unless otherwise indicated, the Platform is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, written posts, articles, newsletters, interactive features etc. on the Platform (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property laws of India, foreign jurisdictions and international conventions. Except as may be expressly provided, no part of the Platform and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, framed, mirrored or used for the creation of any derivative works or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. Users may download and store the Content or Marksfor personal use. Users are not permitted to reverse-compile, disassemble, reverse-engineer or otherwise replicate any part of the Platform including the Content and Marks.

The Platform, including all related information, content, materials, products, and services offered or made available through the Platform are provided on an “as is” basis and "as available" basis. We make no representations or warranties of any kind, express or implied, including without limitation: (a) any implied warranties of merchantability, satisfactory quality, suitability, reliability, completeness, performance, fitness for a particular purpose, title, or non-infringement; and/or (b) that the Platform will meet users’ requirements, will always be available, accessible, uninterrupted, timely, secure, operate without error, or will contain any particular features or functionality; and/or (c) any implied warranty arising from course of dealing or trade usage, unless otherwise specified in writing. Users expressly agree that their use of our Platform is at their sole risk and that users are using their best and prudent judgment before entering into any transactions using our Platform; and/or (d) The Platform and/or any electronic communications sent byus or our affiliates are free of viruses or other malware or harmful components.

There may be certain content, information, products and/or services made available on the Platform and offered by third parties. At no time shall any right, title or interest in the products and/or services made available on the Platform by third parties, vest with us nor shall we have any obligations or liabilities in respect of any transactions between users and such third parties. We shall neither be liable nor be responsible for any actions or inactions or any breach of conditions, representations or warranties by such third parties and hereby expressly disclaimany and all responsibility and liability in that regard. We do not implicitly or explicitly support or endorse the products and/or services offered by such third parties.

To the fullest extent permitted by applicable law, we and our affiliates (and our and their respective employees, directors, agents and representatives) will not be liable for (a) any indirect, incidental, punitive, or consequential damages arising out of or in connection with this user agreement or the platform (including the inability to use the platform unless otherwise specified in writing. in addition, and without limiting the foregoing, to the fullest extent permitted by applicable law, we and our affiliates (and our and their respective employees, directors, agents and representatives) will not be liable for any damages arising out of or in connection with any services or products purchased or transactions entered into through our Platform; and/or (b) any failure or delay by us (or our employees, agents, or representatives) in performing our obligations, where such failure or delay is caused by unforeseeable circumstances or circumstances beyond our control, or where we are bound by other legal obligations under applicable law.

Notwithstanding anything to the contrary, our maximum liability to you for any claims arising out of your use of or access to the Platform and/or any products or services, shall not exceed INR 1000/- (Rupees One Thousand Only).
